The law

Is online notarization legal in Texas?

Yes. Texas was one of the first states to adopt online notarization. House Bill 1217 (2017) created the Texas online notary public commission, and online notarizations have been valid in Texas since July 1, 2018.

Texas law is signer-friendly: under Texas Government Code § 406.110, an online notary may notarize for a signer "regardless of whether the principal is physically located in this state." That means Texans who are traveling, deployed, at college out of state or living abroad can still notarize Texas documents.

Every online notarization in Texas is completed over two-way audio-video, and the notarial certificate states that it was an online notarization. Identity is confirmed through credential analysis of your government ID plus identity-proofing questions.

Before you start: Texas checklist

  • If your document is going to a title company, lender or court, confirm they accept online notarization before your session. Most Texas title companies do, but each one sets its own policy.
  • Texas home-equity (Section 50(a)(6)) loans have special closing-location rules under the Texas Constitution. Ask your lender before planning to sign those documents remotely.
  • Have a valid, unexpired government photo ID (Texas driver's license, ID card or U.S. passport) and a device with a camera and microphone.
